These Terms of Service (“Terms”) govern your use of winwinagent.org and the courses, workshops, coaching resources, newsletters, community features, artificial-intelligence tools, and other content or services offered by Win-Win AGENT, Inc. (“Win-Win AGENT,” “we,” “us,” or “our”).
By accessing or using our website or services, you agree to these Terms. If you do not agree, please do not use the services.
Win-Win AGENT provides educational content, tools, workshops, courses, coaching resources, publications, and community offerings related to conflict navigation, negotiation, communication, and collaboration.
Some offerings are delivered through third-party platforms, including Podia and ChatGPT. Your use of those platforms is also subject to their applicable terms and privacy policies.
Our materials and services provide educational and informational support. Our general educational materials and AI-based services do not provide legal, medical, mental-health, financial, or other licensed professional advice.
You remain responsible for your decisions, communications, actions, and outcomes. No particular outcome from using our frameworks, materials, courses, workshops, or AI Coach is guaranteed.
Certain services require enrollment, authorization, or an account with a third-party provider.
Provide accurate enrollment information, protect your account credentials, and use accounts and access permissions only as authorized.
Win-Win AGENT AI Coach is an AI-assisted educational and coaching resource based on Dr. Sam Bayer’s AGENT framework. The plugin publisher is Dr. Sam Bayer.
The current pilot is free. Pilot access lasts 14 days from enrollment and requires an authorized account. Follow the installation and connection instructions and connect using the email address registered for your pilot access.
Coaching conversations take place in your own ChatGPT account. ChatGPT is operated by OpenAI and is subject to OpenAI’s applicable terms, privacy practices, account requirements, and service limits.
Our Access Manager stores account and access information used to verify authorization. It does not store coaching conversations.
AI-generated responses may contain errors, misunderstand your circumstances, or suggest approaches unsuitable for your situation. Use your own judgment and verify information before relying on it for important decisions. The AI Coach is not an emergency service.
Pilot features, availability, and access procedures may change during testing. These Terms do not establish purchase, subscription, or renewal terms for any future paid AI Coach offering.
Use our services for their intended personal, educational, or professional purposes.
You may not:
violate applicable law or another person’s rights;
disrupt the operation or security of the services;
attempt to bypass access checks or obtain unauthorized access;
impersonate another person or misrepresent your authorization;
infringe intellectual-property or privacy rights; or
reproduce, distribute, sell, or commercially exploit proprietary materials without permission, except as permitted by law.
We may restrict access when reasonably necessary to protect our services, users, intellectual property, or legal rights.
Original materials made available through our services are owned by or licensed to Win-Win AGENT, Inc. or their identified rights holders and are protected by applicable intellectual-property laws.
Access does not transfer ownership of those materials. You may use supplied materials for their intended learning purposes. Other reproduction, publication, redistribution, modification, licensing, or commercial exploitation requires permission unless permitted by law.
These Terms do not determine ownership of content you enter into ChatGPT; applicable platform terms also govern that content.
You are responsible for information and materials you submit through forms, surveys, courses, community features, support communications, or other services.
Share only information appropriate for the service and respect other people’s privacy. Consider carefully whether to enter personal, confidential, proprietary, or sensitive information into third-party AI services.
Our services may use or link to providers such as Podia, OpenAI, and other technology providers. Those providers operate independently and have their own applicable terms and privacy practices.
We do not control their operation, availability, content, or policies.
We may add, modify, suspend, or discontinue features or offerings. We do not guarantee uninterrupted or error-free availability, including where services depend on third-party technology.
To the extent permitted by applicable law, our website, content, and services are provided on an “as is” and “as available” basis.
We do not guarantee that they will meet every user’s needs, produce a particular outcome, or operate without interruption or error.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
To the extent permitted by applicable law, Win-Win AGENT, Inc. and its officers, directors, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the services.
Nothing in these Terms limits liability that cannot lawfully be limited.
Our handling of personal information is described in our Privacy Policy.
Third-party services may separately process information under their own privacy policies.
We may update these Terms as our services change. The current version will be posted on this page with its effective date.
Continued use after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
